Terms of Service
Operator: LAGOON Media, [registered address — TBD], Switzerland ("we", "us", "LAGOON"). These terms govern use of the LAGOON service — a continuously AI-generated, chat-steered live video channel — at lagoons.tv.
1. What LAGOON is
One picture, generated live by an AI model, running continuously. Viewers type prompts in chat; the queue service (PLAN.md §4(g)) decides whose prompt airs next, weighted by tier and fairness rules published on the site. There is no on-demand replay, no clip library, and no guarantee that any specific moment will be preserved — see "Director windows," below. This is the product, not a limitation of it.
2. Eligibility
You must be 18 or older. Where a jurisdiction legally requires a specific age-verification standard, our Age Verification Policy applies it as a condition of access to the relevant lane of the service. You may not use LAGOON if you are located somewhere subject to comprehensive sanctions administered by Switzerland, the EU, the UK, or the US, to the extent those sanctions bind LAGOON Media.
3. Accounts
You're responsible for your account credentials and for prompts submitted under your account. Every account gets a free daily allowance of prompts at no cost. Beyond that, the pricing page lists one-off credit packs (Taste, Starter, Standard, Big) and two subscriptions (Regie, Sender) that additionally carry queue priority and a named on-screen credit — see §8 for why every button on that page currently reads "Opens at launch." We may suspend or terminate an account for violating the Acceptable Use Policy.
4. Prompts, and what you're granting us
By submitting a prompt, you grant LAGOON Media a worldwide, non-exclusive, royalty-free license to process it, generate video from it, broadcast that video, and retain a record of it (prompt text, timestamps, and the resulting broadcast window) as described in our Privacy Policy and Record-Keeping Policy. You represent that you have the right to submit the prompt and that it doesn't infringe a third party's rights — this doesn't override the Acceptable Use Policy, which governs separately what content is permitted at all.
5. Director windows — what "yours" means here
There are no clips in this product, so there's no clip to own. The unit of the broadcast is
the director window: the span of air-time your prompt controls, from the moment it
takes effect until the next prompt (or your own /cut) supersedes it. While your window is
live, the broadcast overlay credits you by handle. When the window ends, that moment has
aired and moved on — it isn't archived as a standalone asset you can retrieve later, beyond
whatever the share feature captures (client-side, watermarked, last 30 seconds). We're
telling you this plainly because it's a real trade-off, not a footnote: your moment on
LAGOON is something you were there for, not something you're issued afterward.
6. Output ownership
Generated video is produced by an AI system and reflects contributions from many users' prompts over a broadcast's lifetime — it is not a discrete work any one user commissioned. LAGOON Media retains the broadcast recording for the retention period described in our Privacy Policy and Record-Keeping Policy, primarily for moderation, legal-compliance, and safety purposes, not as a content product for resale.
7. AI disclosure
Every broadcast carries a persistent on-screen marker identifying it as AI-generated, plus a machine-readable manifest, in line with the EU AI Act's transparency requirements. This is not optional, cannot be disabled by a prompt, and is described further on our Trust & Safety page.
8. Payments
At launch, LAGOON takes no money — every tier is free, and paid tiers activate only once described here and on the pricing page. When payments go live, this section will be updated with pricing, refund policy, and the payment processors used.
8.1 If you delete your account while a payment is still going through
Crypto payments are not instant. There is usually a gap of some minutes between you paying and our being told the payment cleared. If you delete your account during that gap, the credits have nowhere to go: the account they were bought for no longer exists, and we do not create a new one to hold them. We keep the money, and it is not refunded automatically.
We would rather you had it. If this happens to you, write to us at the address in section 13 with the date and the payment reference, and we will look at it and refund you where we reasonably can. Please note that we may not be able to verify a payment against an account we no longer hold any record of, and a refund is at our discretion rather than a guarantee.
If you are about to delete your account, the simplest thing is to wait until any payment you have started shows up in your balance first.
9. Termination
We may suspend or terminate access for violating these Terms or the Acceptable Use Policy, including via IP or domain block for serious or repeated violations. You may stop using the service at any time.
10. Disclaimers and liability
The service is provided "as is." Output is AI-generated from live, uncensored prompts within the legal boundaries described in our Acceptable Use Policy — we do not warrant that any specific broadcast will be free of content some viewers find upsetting, provided it is legal. To the maximum extent permitted by Swiss law, LAGOON Media's liability is limited as will be specified by counsel; this section is a placeholder for a lawyer-drafted limitation-of-liability clause, not one itself.
11. Governing law
These Terms are governed by the laws of Switzerland. Venue and dispute-resolution mechanism (courts of Zürich vs. arbitration) to be specified by counsel.
12. Changes
We'll date and note material changes to these Terms at the top of this document once it's live, and — where required — notify account holders directly.
