DMCA Notice & Takedown Policy
LAGOON Media operates LAGOON from Switzerland. We're not a US company, and DMCA safe harbor (17 U.S.C. §512) is a US statute — whether it applies to us, and whether relying on it requires registering a US-based designated agent with the US Copyright Office, is an open legal question this draft does not resolve. We publish this policy anyway, because most of our peer platforms do, because a meaningful share of our audience and rights-holders will be US-based, and because having a clear, fast copyright process is good practice independent of which statute technically compels it.
Filing a notice
If you believe content broadcast on LAGOON infringes your copyright, send a notice to [email protected] including:
- Your name, address, phone number, and email.
- A description of the copyrighted work you claim is infringed.
- Where on LAGOON the allegedly infringing content appeared or is likely to reappear (given the nature of a live, continuous broadcast, this may mean a description of the prompt/reference material rather than a URL to an archived clip — see Terms of Service §5 on why there's no persistent clip archive by design).
- A statement that you have a good-faith belief the use is not authorized.
- A statement, under penalty of perjury, that the notice is accurate and you're authorized to act on the copyright owner's behalf.
- Your physical or electronic signature.
What happens next
We review every notice. Where the claim concerns our own curated reference-asset library (the only user-facing reference-image surface in v1 — see PLAN.md §7's text-prompts-only scope), we can remove or restrict the specific asset. Where the claim concerns a live broadcast in progress, we escalate to our kill-switch process (see Trust & Safety) if warranted. We'll respond to the notice sender with the outcome.
Counter-notice
If you believe content was removed in error, you may submit a counter-notice to the same address, with your contact information, an identification of the removed material, and a statement under penalty of perjury that you have a good-faith belief the removal was a mistake. The specific reinstatement timeline (DMCA's US framework gives 10-14 business days) has not been confirmed as applicable to a Swiss operator and should be set by counsel, not assumed.
Repeat infringers
An account with multiple confirmed copyright violations may be suspended or terminated, in line with our Terms of Service and Acceptable Use Policy.
Designated agent
Not yet registered. If counsel confirms DMCA safe harbor is worth relying on despite our Swiss incorporation, this section will name a registered US designated agent and their US Copyright Office registration number. Until then, use the contact address above.
